If there is a conflict between this Notice and applicable law, the applicable law will control.
2. What Is Protected Health Information (PHI)?
Protected Health Information (PHI) is individually identifiable health information that is created, received, maintained, or transmitted by or on behalf of a HIPAA covered entity or business associate and is protected by HIPAA.
PHI may include your name and contact information when associated with healthcare information, date of birth, medical history, current and previous medications, allergies, symptoms, laboratory and diagnostic results, biomarker information, provider notes, treatment recommendations, health assessments, care and follow-up information, and information concerning your healthcare services or payment for those services.
Not all information collected through our website is PHI. Information collected solely for general website, marketing, or administrative purposes may instead be governed by applicable privacy laws and the general provisions of this Privacy Policy.
3. Information We Collect
A. Information You Provide
When you request a consultation, complete a form, communicate with us, or use our services, we may collect your name, email address, telephone number, date of birth, address, health goals, lifestyle information, medical history, medications, allergies, symptoms, laboratory results, health records, biomarker information, payment and billing information, your communications with our team, and information necessary to coordinate healthcare services.
B. Information Collected Automatically
When you visit our website, we may collect your IP address, browser type, device information, operating system, pages viewed, time spent on the website, referral source, and cookies and similar technologies. We use this information for website functionality, security, analytics, performance, and other legitimate business purposes, subject to applicable law.
4. How We May Use and Disclose Your Information
When HIPAA applies, we may use or disclose your PHI without your separate written authorization for purposes permitted by HIPAA, including treatment, payment, and healthcare operations.
Treatment
We may use or disclose PHI to provide, coordinate, or manage your healthcare, including sharing relevant information with providers, laboratories, pharmacies, or other healthcare professionals involved in your care.
Payment
We may use or disclose PHI as necessary to obtain payment for healthcare services or to process healthcare-related billing.
Healthcare Operations
We may use or disclose PHI for quality assessment and improvement, care coordination, reviewing provider performance, auditing, compliance activities, business administration, patient safety activities, and planning and management of healthcare services.
Business Associates
We may disclose PHI to vendors and service providers that perform services for or on our behalf when those services require access to PHI. Where required by HIPAA, we enter into appropriate Business Associate Agreements and require our business associates to safeguard PHI.
Other Permitted Disclosures
We may use or disclose PHI when required by federal, state, or local law; for public health activities; for health oversight activities; in response to judicial or administrative proceedings or lawful process; to law enforcement when permitted or required by law; to prevent or lessen a serious and imminent threat to health or safety; and as authorized for workers’ compensation programs.
5. Uses and Disclosures Requiring Your Authorization
Certain uses and disclosures generally require your written authorization, including certain uses and disclosures of psychotherapy notes, uses and disclosures for marketing, and disclosures that constitute a sale of PHI. We will obtain your authorization when required by law before making such uses or disclosures. We will not sell your PHI.
If you provide an authorization, you may generally revoke it in writing at any time, except to the extent action has already been taken in reliance on that authorization.
6. Cookies and Analytics
We use cookies and similar technologies to keep the website working properly, understand how visitors use our pages, measure the performance of our communications, and improve our services. You can control or delete cookies through your browser settings. Disabling certain cookies may affect how parts of the website function.
7. Your Rights Regarding Your PHI
You have the right to inspect and obtain a copy of PHI we maintain about you in a designated record set, subject to certain legal exceptions, and to receive an electronic or paper copy. We may charge a reasonable, cost-based fee where permitted by law.
You have the right to request an amendment if you believe information we maintain about you is incorrect or incomplete. We may deny a request in certain circumstances permitted by law, in which case we will explain the reason and your right to submit a statement of disagreement where applicable.
You have the right to request confidential communications, such as asking that we contact you by telephone rather than email or at an alternative address. We will accommodate reasonable requests as required by HIPAA.
You have the right to request restrictions on how we use or disclose your PHI for treatment, payment, or healthcare operations. We are not required to agree to every request. However, where you have paid for a healthcare item or service completely out of pocket and request that the information not be disclosed to your health plan, we will generally honor that request when required by HIPAA unless disclosure is required by law.
You have the right to request an accounting of certain disclosures of your PHI made during the period permitted by HIPAA. The accounting generally does not include disclosures for treatment, payment, healthcare operations, or other disclosures excluded by law.
You have the right to receive a paper copy of this Notice at any time, and to choose a personal representative who may exercise certain rights on your behalf. We may require documentation establishing that person’s authority.
You have the right to be notified following a breach of unsecured PHI, as required by applicable law.
8. How to Exercise Your Rights
To exercise any of the rights described above, contact Ocean Wellness using the contact information at the bottom of this page. We may ask you to verify your identity before acting on a request.
If you believe your privacy rights have been violated, you may file a complaint with us or with the Secretary of the U.S. Department of Health and Human Services. We will not retaliate against you for filing a complaint.
9. Data Security
We maintain administrative, technical, and physical safeguards designed to protect personal information and PHI from unauthorized access, disclosure, alteration, or destruction. However, no method of transmission over the internet or method of electronic storage is completely secure. You share information with us at your own risk.
10. Data Retention
We retain personal information and PHI for as long as necessary to provide services, satisfy legal, regulatory, and contractual obligations, resolve disputes, and enforce our agreements. When information is no longer required, we dispose of it in accordance with applicable law.
11. Third-Party Service Providers and Links
We may share information with independent laboratories, pharmacies, phlebotomists, technology providers, scheduling platforms, payment processors, and delivery companies that help us operate our services. These providers may have their own privacy policies and practices. Our website may link to third-party sites that we do not control, and we are not responsible for their privacy practices.
